Mercury Exports & Manufacturing Private Limited had filed the suit against Punjab National Bank, inter alia, praying for permission by the Punjab National Bank to operate its bank account without marking any lien and also for decree for a sum of Rs. 15,36,560.40 on 26th February, 2022. The defendant, bank had failed to file their written statement on time and filed an application for extension of time to file written statement being G.A. 5 of 2022 in C.S. 36 of 2020.
In a recent order passed by the Hon’ble Justice Krishna Rao on 16th January, 2023 in an application for extension of time of file written statement filed by the defendant, the Court took into account the time limits for filing Written statement in a suit governed by the provisions of the Commercial Courts Act, 2015 and dismissed the defendant’s application for extension of time to file written statement beyond the period prescribed under the Commercial Courts Act, 2015.
In view of the aforesaid, the defendant’s right to file written statement was forfeited and the Court was pleased not to allow the written statement to be taken on record.
